Well some of you know the story of how our treasurer died in April 2007 and how since then I have been struggling to have her name taken off the charity
accounts and the accounts sent to me. It has been 15 months but at last we have succeeded, by going to the top and threatening ombudsmen, charity commission
and the media. Sadly during this time all of our statements etc. which they assured me were just being held at the bank, have been destroyed.
They are giving us £200 compensation but even so i am blooming angry

Oh Tina, I am not surprised you are angry. They are a law unto themselves aren't they.
Do they not have copies of the statements on their system somewhere? Surely an ongoing account should still have files on their main computer? Sue xx |

Exactly and for that you need the statements, I assume!!
Words fail me as to how these financial institutions get away with so much. One law for them and one for the rest of us! Don't get me on that soap box or I will be here for years!! Hope you DO get it sorted Tina. Sue xx |

Thanks Sue. I don't think I will get any further by pursuing this. They have ammended the details now so I guess I should just accept the money on the
charity's behalf and be done with it. They can't produce what they haven't got. I think head office is very annoyed at the branch though and
hopefully they will give them the shake up they need for someone else not to have all this. At least as soon as the paperwork comes in I can do the charity
returns and use the account again.

Tina, there is no reason why the bank can't order duplicate statements on your behalf - it should only take them a couple of days. Oh, and make sure they
don't charge you for them (approx £5 per sheet) - as it is their fault.

I believe they have a legal obligation to keep records and being though it is only the last 18 months or so, they should have "electronic" copies of
these - even if it's only the last 6 months.
Working in the financial sector myself (not at a bank), we have to keep certain documents for a minimum term (generally circa 7yrs!!!) If I were you though I would pursue your claim, although you probably don't want the hassle - and most banks count on people not wanting to go through what would most likely be a lengthy process. Seems a bit odd that they can help with new statements. I thought they had to keep records for legal reasons. I was under the impression the Inland revenue can
go back 7 years and audit your finances if they think you haven't paid enough tax, and the police can sieze bank records as part of an investigation.
Perhaps any dodgey dealings need to be switched to your bank so they can't be traced once you have destroyed your bank statements. I think if you lodge a formal complaint you will have that as proof of what's happened so that you have it for the charity commission if they start checking. Better safe than sorry, it will act like an insurance policy in giving you some peace of mind. It won't solve the problem or do anything for your anger but it's the best you can do in the circumstances. You might consider changing banks, eventually they will realise that poor service costs customers and clean up their act. Jan |

This was a formal complaint to the bank and I have to sign to say I accept the money offered (not asked for) as settlement. They have ammended teh records and
they are sending me the latest statements but I will write back and see if there are any on their system,. I think by law they had to offer me the chance to
take it to the ombudsman etc. but I don't want any more hassel, after 15 months I am just glad that the end is in sight.
